Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Emmet Sproul, an individual based in Christchurch, New Zealand ("we", "us", "our"), the operator of the Kindred mobile application ("Kindred", "the app").
By creating an account, signing in, or otherwise using Kindred, you agree to these Terms. If you don't agree, don't use the app.
These Terms work alongside our Privacy Policy. If anything's unclear, email us at anyaclawbot@gmail.com.
1. Who can use Kindred
- You must be 18 or older. Kindred is strictly an adult dating app. We verify age at signup. If we find out you're under 18, we will delete your account.
- You must have the legal capacity to enter a binding agreement in the country where you live.
- You may not use Kindred if you're on a US government embargo list, designated as a "terrorist supporting" country, or on any US restricted-parties list.
- One account per person. Don't create accounts on behalf of anyone else.
2. Your account
- Keep your login credentials private. You're responsible for everything that happens under your account.
- Tell us right away if you suspect someone else is using your account: anyaclawbot@gmail.com.
- The information you give us at signup (date of birth, gender, location, display name) must be accurate. Misrepresenting your age is a serious violation and will result in immediate removal.
3. Zero tolerance for objectionable content and abusive behaviour
This is the rule that matters most. Kindred has a zero-tolerance policy for objectionable content and abusive users.
You agree NOT to post, send, upload, record, or share anything that:
- Is sexually explicit, pornographic, or contains nudity
- Depicts, promotes, or incites violence, self-harm, suicide, or harm to others
- Is hateful, harassing, threatening, or discriminatory based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic
- Depicts or promotes the sexual exploitation of children, in any form, ever
- Is intended to bully, intimidate, defame, or stalk another person
- Promotes illegal activity, illegal goods, or illegal services
- Contains spam, scams, phishing attempts, or solicitation (including commercial solicitation, "sugar" arrangements, escorting, or prostitution)
- Infringes anyone else's intellectual property, privacy, or publicity rights
- Impersonates another person or misrepresents your identity in a deceptive way
- Contains malware, viruses, or anything designed to harm Kindred or other users' devices
You also agree not to:
- Harass, stalk, threaten, or abuse other users — on Kindred or anywhere else after meeting through Kindred
- Use Kindred to traffic, exploit, or coerce another person
- Share another user's private information (photos, messages, voice notes, contact details) outside of Kindred without their explicit consent
- Use Kindred for commercial purposes, advertising, or recruitment
- Use bots, scrapers, automation tools, or unauthorized scripts against Kindred
- Attempt to reverse-engineer, decompile, or break the app
- Create a new account after we've removed yours for a violation
Violations are not warned, debated, or appealed lightly. If you do any of the above, your account will be removed, your content will be deleted, and depending on what happened, we may report you to law enforcement.
4. Reporting abuse and objectionable content
If you see something that breaks the rules above, report it inside the app. You can:
- Report a user from their profile, the discover screen, the likes screen, or your chat with them
- Block a user at any time, which instantly removes them from your feed, deletes your match if you had one, deletes the messages between you, and prevents you from seeing each other in Discover or Likes again

5. How we handle reports — our commitment
We commit to:
- Reviewing every report within 24 hours of receiving it
- Removing reported content that violates these Terms, and removing the user who posted it, as soon as we verify the violation
- Taking action even if you didn't formally report it, if we become aware of a violation another way
There is no appeal for clear-cut violations (CSAM, threats of violence, terrorism). For borderline cases, we'll review in good faith and may contact you for context before deciding.
If you're a victim of harm by another Kindred user and need help, contact us at anyaclawbot@gmail.com. If you are in immediate danger, contact local emergency services first — we are not a substitute for emergency response.
6. Content you create on Kindred
You keep ownership of your mood boards, voice notes, messages, profile pictures, and anything else you create on Kindred. By posting it, you grant us a limited license to host, display, and deliver it to other users as part of running the app. This license ends when you delete the content or your account (subject to the retention rules in our Privacy Policy).
You're responsible for making sure you have the right to share whatever you upload. Don't upload images, music, or text you don't have permission to use.
7. The mood board model
Kindred matches people based on mood boards rather than photos of their faces. Profile pictures (avatars) are optional and intentionally de-emphasised. You agree to engage with the mood board model in good faith — don't try to game the system to push face photos, contact info, or links to external profiles into your board content.
8. Termination
We can suspend or delete your account at any time, with or without notice, if:
- We believe you've violated these Terms
- We're required to by law
- We decide to discontinue Kindred (we'd give notice if reasonably possible)
You can delete your account at any time from Settings → Delete Account, or by emailing us. Once deleted, your data is removed according to the timelines in our Privacy Policy.
9. Disclaimers
Kindred is provided "as is" and "as available". We don't guarantee that:
- The app will always work without bugs, downtime, or errors
- You'll find a match, a date, a relationship, or anything else through Kindred
- Other users are who they say they are — we do our best, but we can't verify every claim made on a profile
Kindred is a tool for meeting people. Meeting strangers carries real risk. Use your judgment, meet in public places, tell someone where you're going, and trust your instincts.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Kindred, including any harm caused by another user. Our total liability to you, for any claim arising from these Terms or your use of Kindred, will not exceed NZ$100 or the amount you paid us in the previous 12 months (whichever is greater).
Some jurisdictions don't allow these limits, in which case our liability is limited to the smallest extent permitted by law.
11. Apple App Store terms
If you downloaded Kindred from the Apple App Store, the following also apply:
- These Terms are between you and Emmet Sproul, not between you and Apple. Apple is not responsible for Kindred or its content.
- Apple has no obligation to provide any maintenance or support for Kindred.
- If Kindred fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (Kindred is free, so this is generally not applicable). Beyond that, Apple has no warranty obligation.
- Any claims that Kindred or your use of it violates someone's intellectual property rights are our responsibility, not Apple's.
- You confirm you're not in a US-embargoed country and not on any US restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Governing law
These Terms are governed by the laws of New Zealand. Any dispute will be resolved in the courts of New Zealand, except where local consumer protection law gives you the right to sue in your home country.
13. Changes to these Terms
If we change these Terms in a way that affects your rights, we'll notify you in the app or by email before the change takes effect. Continuing to use Kindred after the change means you accept the new Terms. If you don't accept them, delete your account.
